Sellers Policy


This policy is a part of our Terms and Conditions and sets out your rights and obligations as a Seller and a Store owner on Althemy. By using any of Althemy�s features, you�re agreeing to this policy (referred below also as "the terms") and to our Terms and conditions.



1. Common Rules

Each account holder on Althemy�s platform has the option to create his own website. Each owner of Althemy website has the option to activate an online store as part of his website on which can sell goods and services online. The Online Store is given together with the website when the website is created and will become visible to buyers after the site owner fill in all required data for activation of the Online Store and enters first valid product. Store owner also has an option to deactivate/unpublish the store if he/she no longer wishes to have it visible.
By activating an Online Store on your Althemy website, you agree to abide by the Terms outlined below. The activating of an Online Store on your Althemy website constitutes a binding agreement between you and Althemy and makes you a Store Owner.
When a Store Owner lists an item or product for sale on Althemy and a buyer agrees to purchase the item, the parties have entered into a binding agreement which both parties are required to fulfill. The Store Owner should sell and the buyer should buy the goods or services for the price agreed to by the Store Owner and its buyer. Althemy is not directly involved in the transaction between a Store Owner and a buyer and serves only as a marketplace that only allows the transactions to happen.

2. General provisions for Store Owners

Order fulfillment is the Store Owner�s sole and full responsibility. All products purchased through a Althemy online store must be fulfilled by the Store Owner in a timely manner, and in term agreed between the Buyer and the Store Owner. Failure to fulfill orders may cause Your Store to be suspended by Althemy.


You are responsible for managing all products on your store. You are responsible also for the information about your products and for the images of your products posted on your store. You must correctly and accurately describe all products listed in Your store.

Any attempt to avoid Althemy's transaction fee is forbidden. You should not make such attempts as if you do your store could be removed from the platform.


You may not use your Online Store for any illegal purpose. You may not violate any applicable laws when using your Online Store.

You will be responsible for payment of all applicable taxes, fees and government charges, for each sale made through Your Online Store.

Althemy on its own discretion at any time may decide to remove each Online Store from the platform.


3. Requirements on the Store's content

Its Store Owner�s duty to ensure that all products listed for sale in his Online Store are in conformity with all applicable laws. If we conclude that a product is prohibited, possibly illegal or inappropriate, we may without any notice to you immediately remove this product. Althemy reserves the sole right and discretion to determine whether listings for products and contents on the Site are appropriate.

Products, items and services which are illegal offensive, racist, pornographic or abusive in any way are not permitted to be sold or listed for sale on your Store.
Each Store Owner is obligated to enter correct shop/personal/ payment details, shop description and shipping policies as part of his Online Store.


4. Community Policy

Except as a marketplace Althmey serves also as a Community. Each member and visitor on Althemy can use our community features to interact with others, to inspire each other, to share knowledge, discuss ideas, and build personal and professional relationships. Community spaces on Althemy includes the Forum section, Journals section, websites of the account holders and the functionality for comments. To make sure that Althemy is a place that�s safe and respectful, the following policies apply to all community spaces:

1. Respect other members� privacy. Private or personally identifying information should not be shared in public areas of the site.
2. Community tools or features may not be used to interfere with another member�s business.
3. Be respectful towards other members. Community spaces may not be used to publicly disparage a specific member, shop, or item.
4. Community spaces may not be used to harass other members. Similarly, content posted in community spaces may not promote, support, or glorify hatred.
5. You may not publish or post threats of violence against others or promote or encourage others to engage in violence or illegal activity.


5. Forums
The Forums are divided into different sections, including Support forums, Categories discussion and etc.

Please keep in mind that the Forums are a public space, and that your posts are permanent (unless they are deleted by Althemy for violation of our policies). Your posts should not disparage or violate the privacy rights of another member. Every member is responsible for what they post in the Forums. Forums moderators may take certain actions to keep the Forums organized and helpful for everyone.

6. Fees

Transaction Fees
When you make a sale through your Online Store, you will be charged a transaction fee of 3% from the value of the purchase. This fee does not include any government taxes and fees applicable to the sale for which you have responsibility as a seller.

Fee Avoidance
Any action by a seller to avoid paying a fee is considered fee avoidance and is strictly prohibited. This includes, for example, encouraging buyers to purchase an item in your Althemy Online Store through another venue. The price stated in each listing description must be an accurate representation of the sale. Sellers may not alter the item's price after a sale for the purpose of avoiding Althemy transaction fees.
Digital VAT (Value-Added Tax) Fees
Under European Union law, when you sell a digital item that is downloaded automatically to a buyer living in the EU and where digital services are supplied on a business to consumer basis, the supplier is responsible for accounting for VAT on the supply.VAT (a value-added tax) must be collected based upon the rate that is charged in the country where the buyer is located.
Digital goods are defined in the legislation as broadcasting, telecommunications, and services that are electronically supplied instead of shipped. Gift cards sent online are not included in the definition.

It's your obligation as a Store Owner to comply with these requirements if they are applicable to you.


7. Intellectual Property Policy

Reporting
If content that you own or have rights to has been posted to Althemy without your permission and you want it removed, please inform us and if your request meets the requirements for legitimate and lawful request which express the rights of the true owner of the copyrights, the content will be taken down.

If you would like to submit a notification of alleged infringement, counter a notice of copyright infringement submitted against you, or withdraw a notification of infringement that you submitted, please contact us on mail@althemy.com

Notices of Intellectual Property Infringement
We try to respond quickly each time we receive proper notice of intellectual property infringement by removing or disabling access to the allegedly infringing material. When we remove or disable access in response to a notice, we will make a reasonable attempt to contact the allegedly infringing party, provide information about the notice and removal, and, in cases of alleged copyright infringement, provide information about counter notification. We may also provide a copy of the notice to the allegedly infringing party.
Counter Notification
If we receive a counter notification with solid proof for the intellectual property over the object, from the side of the seller, the removed material may be replaced or access to it may be restored (we have the right to make an independent judgment each time). If the copyright owner files an action seeking a court order against the allegedly infringing party and informs us of this action we will take down the content (the item) till the argument is resolved. We will send a copy of the counter notice to the original complaining party.
Repeat Infringement
Althemy will terminate the account of members that are subject to repeat notices of intellectual property infringement. The decision to terminate such account is solely to at Althemy�s discretion.

8. Shipping Policy

Sellers are responsible for shipping their sold items to buyers. If you're using a shipping or fulfillment service, please keep in mind that you are ultimately responsible for making sure that your buyers receive the item(s) they purchased from your shop.
By selling on Althemy, you agree to:
1. Provide an accurate "ships from" address.
2. Specify your shipping costs and processing times in your listings.
3. Ship items promptly after they are sold.
4. Comply with all local and international shipping and customs regulations.
5. Charge an appropriate amount for shipping.

9. Prohibited Items Policy

We prohibit certain types of items from selling via Althemy. Some items present legal risks to our community, others are inconsistent with our values, are harmful to our members, or simply are not in the spirit of Althemy. This policy explains what is prohibited or restricted on Althemy.

The following types of items are prohibited or restricted on Althemy:
1. Alcohol, Tobacco, Drugs, Drug Paraphernalia, and Medical Drugs
2. Dangerous Items: Weapons
3. Hate Items: Items that Promote, Support, or Glorify Hatred
4. Illegal Items, Items Promoting Illegal Activity, and Highly Regulated Items
5. Internationally Regulated Items
6. Pornography and Mature Content
7. Violent Items: Items that Promote, Support, or Glorify Violence

We reserve our right to decide each time does one item or service is compliant with our policy and spirit or is not. Because we are a creative community, we are on the side of freedom of expression. We tend to allow items that have educational, historical, or artistic value.
It�s solely to our discretion to allow or to ban an item or service on your online shop.


10. Disputes


If a dispute arises between You and Althemy, We will seek to resolve the dispute as quickly as possible. Before resorting to legal proceedings, You must first contact Us directly and work with Us to resolve the dispute. For any matter which is not regulated in these terms the Bulgarian law will be applicable. In case of a legal dispute between the parties (the Store Owner and Althemy) the parties agree that the relevant court in Sofia, Bulgaria will be empowered to resolve the dispute according to the Bulgarian law.


11. Final provisions

We may update these Terms (Policy) from time to time.We reserve the right to alter or amend these Terms or other Site policies at any time. Every time we make any changes we will notify you by posting a massage for the changes on a visible place in Althemy website. That way you can decide whether you want to continue using the Services. Changes will be effective upon the posting of the changes. You are responsible for reviewing and becoming familiar with any changes. Your use of the Services following the changes constitutes your acceptance of the updated Terms.

If any part of the Terms is found to be unenforceable, that part will be limited to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
