2. Description of the Service

Althemy�s web-based Service allows users who register for an account (each an "Account Holder") to visit websites hosted on our platform, to post comments, to shop on the e-shops when they are part of the websites and to interact in different ways with the platform. Once registered, each Account Holder may create his or her own Web Site and may post "Content" (defined in Section 5). The users have also the option of creating an online stores on their websites through which they can sell goods and services online. Althemy is entitled to provide additional types of services to the site owners, including but not limited to: site design, support, marketing services and other related services.These services are available through predefined packages.

Althemy serves as an online marketplace that allows qualifying users to offer, sell and purchase goods and services for an agreed upon price. Althemy has no involvement in the consummation of a contract between a seller and a buyer. Accordingly, Althemy has no liability or responsibility for any matter arising out of the transaction between a seller and a buyer. Althemy can collect a fee for every purchase made trough the platform (transaction fee). The transaction fee amounts to 2.5% from the value of the purchase.

Althemy decides whether their services are paid or free and have the right to reconsider at any time. The services may be provided also against remuneration, comprised from points or other predefined by Althemy alternative values.

Althemy�s point system provides the opportunity to the users to either buy points or to earn them as interact with the platform. Points can be earned by commenting on other Althemy websites, generate visits and purchases.

Althemy reserves the right to offer some of his services only to chosen users of the platform. At the moment this kind of service is �Face of Althemy�. The user who wants access to this service needs to make an inquiry as Althemy reserves the right to choose whether to provide the service.

3. Privacy policy
Althemy takes all measures to protect all personal information related to the users in accordance with the applicable legislation. For more information regarding Althemy's Privacy policy please read our Privacy policy section. By using the Service, You are accepting and agreeing to the terms of Althemy�s Privacy Policy, which You acknowledge You have read and fully understand.

4. Registration
To register as an Account Holder, you must provide us with a valid email address username and password (Registration Data). In case you decide to purchase goods and services from or via Althemy or in case you decide to open a shop on your Althemy website you will be asked to provide additional data including but not limited to: full name, address and etc. (Additional data). The provision of this additional data is a requirement for your use of these functionalities. You are responsible for maintaining the confidentiality of the password and all other information related to your account. You are responsible for all activities that occur under your account. In consideration of use of the Service, you agree to maintain and update true, accurate, current and complete Registration Data and Additional data. If you provide any information that is untrue, false, inaccurate, not current or incomplete, or if Althemy has reasonable grounds to suspect that such information is untrue, false, inaccurate, not current or incomplete, or there are doubts that the account holder violates the law in any kind we may suspend or terminate your account and any other accounts related to you and refuse any and all current or future use of the Service or any portion thereof.
At any time Althemy may ask from the user to legitimate himself and to certify the authenticity of the registration data.
Individuals under the age of 13 are prohibited from creating or using accounts through Althemy.com.

5. Content
Any content that you post using our Services needs to be consistent with these Terms and conditions. Althemy does not claim ownership of your Content, but you give us your permission to host your Content on the Service. By posting Your Content through our Services, you grant Althemy a non-exclusive, worldwide, royalty-free license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of Your Content to provide the Services and to promote Althemy and your Althemy website.

Your content includes anything you post using our Services including but not limited to usernames, shop names, profile pictures, pictures, listing photos, listing descriptions, reviews, comments, videos, etc.


By accepting these terms You declare that You understand that you are solely responsible for Your Content. You represent that you have all necessary rights to Your Content and that you�re not infringing or violating any third party�s rights by posting it.You and only you are responsible for your content and for the implications it may cause.

If Your Content infringes another person�s intellectual property, we will remove it if we receive proper notice. We�ll notify you if that happens.

You agree that you will not post any content that is abusive, threatening, defamatory, obscene, vulgar or otherwise offensive or in violation of any part of our Terms. Althemy would like to give you freedom to express yourself by any means you want, for instance we will not prohibit content which includes nudity as long as it can be considered as art not as pornography. We also value the freedom of speech, so we will be as tolerant as we can with your posts.

Althemy have the right to take down any content that is not in accordance with this section. It's Althemy's right to decide if user content is in accordance with this section.


6. Copyright Infringement

If content that you own or have rights to has been posted to Althemy without your permission and you want it removed, please inform us and if your request meets the requirements for legitimate and lawful request which express the rights of the true owner of the copyrights, the content will be taken down.


7. Your use of Althemy

You may use the Services and the Site and the content owned and provided by Althemy solely in connection with the intended purposes of the Site. No right, title or interest in any Althemy Content is transferred to You. Althemy retains all of its intellectual property rights in all Althemy Content. - Violate any applicable laws or the rights of third parties.
- Access or use the Site if You are not able to enter into legally binding agreements or you are temporarily or indefinitely suspended from Althemy.
- Fail to deliver payment for items purchased by You.
- Fail to deliver items purchased from You if You are a Seller.
- Infringe on another party�s right, title and interest in and to their intellectual property including copyrights and trademarks.
- employ any actions which may harm Althemy, Althemy content or the interests or property of Althemy users.
- Copy, modify, or distribute content from the Site and/or Althemy�s copyrights and trademarks unless agreed to by Althemy.
- Collect information about users, including email addresses, without their consent.


You are responsible for paying all fees that you owe to Althemy. You are also solely responsible for collecting and/or paying any applicable taxes for any purchases or sales you make through our Services.

Under this Terms, it remains the responsibility of the sellers (not the platform operator Althemy) to ensure compliance with the legislation relating to online sales that they perform from their online stores based on their websites created on Althemy platform.

We may terminate or suspend your account (and any accounts related to you) and your access to the Service at any time, for any reason, and without advance notice. If we do so, it�s important to understand that you don�t have a contractual or legal right to continue to use our Service

We may refuse service to anyone, at any time, for any reason.

If you or Althemy terminate your account, you may lose any information associated with your account, including Your Content.
We have the right to Discontinue our Services. We can change, suspend or discontinue any of the Services we offer at any time, for any reason. We will not be liable to you for the effect that any changes to the Services may have on you. These Terms will remain in effect even after your access to the Service is terminated, or your use of the Service ends.


8. Rules for website listing
Only approved sites that are completed and belong to predefined criteria (listed below) are listed on Althemy and can be found trough Althemy search and browse system. If the site is not listed it can still be accessed through direct link and used normally. Owners of both listed and unlisted sites have 1 month to renew their sites after they expire, by earning or buying points.
The criteria for listing of websites on Althemy are the following:
1. The theme of the site needs to correspond with Althemy and it needs to belong to one of predefined subcultures listed here: http://www.althemy.com/help/view-article/28-categories
2. The site needs to be completed, meaning it needs to have:
logo, background (wallpaper, youtube background or color background), 3 slider photos, 'About' text and banner for 'About' page.
Depending on the chosen layout the site needs to have the minimum material published:
- gallery layout - 9 photos
- blog layout - 3 blog posts
- news layout - 3 blog posts
- video layout - 9 youtube videos
- max news gallery - 3 blog posts+ 6 photos
- max news video - 3 blog posts+ 6 youtube videos

3. Elements of the site that aren�t used need to be turned off in the control panel and the site needs to be esthetically/visually well � rounded.
Althemy reserves his right to unlist or terminate website whenever we decide that this website (or related sites) is in conflict with those terms or with the theme and the purpose of Althemy.


9. Warranties and Limitation of Liability

Althemy makes no representation or warranty of any kind concerning the truth or accuracy or any other aspect of any information posted on this website by a User or any other information appearing at websites which are linked to in any Third Party Content.

Althemy cannot and does not make any warranties about the quality, safety or the legality of the items sold through our Services. Any legal claim related to an item you purchase must be brought directly against the seller of the item. You release Althemy from any claims related to items sold through our Services, including for defective items, misrepresentations by sellers or items that caused physical injury (including all kind of product liability claims).

We make no representations concerning any content posted by users through the Services. We are not responsible for the accuracy, copyright compliance, legality or decency of content posted by users that you access through the Services. You release us from all liability relating to that content.

You can use the Services to interact with other individuals, either online or in person. We do not screen the users of our Services, and you release us from all liability relating to your interactions with other users.

Our Services may contain links to third-party websites or services that we don�t own or control. You may also need to use a third party�s product or service in order to use some of our Services When you access these third-party services, you do so at your own risk. These Terms and conditions are governed by the laws of the Republic of Bulgaria. Bulgarian laws will apply to any matter related to these Terms. Any legal action against Althemy related to our Services must be filed and take place in Sofia, Bulgaria where Althemy is based.


11. Changes to Althemy�s Terms and conditions

We may update these Terms from time to time.We reserve the right to alter or amend these Terms or other Site policies at any time. Every time we make any changes we will notify you by posting a massage for the changes on a visible place in Althemy website. That way you can decide whether you want to continue using the Services. Changes will be effective upon the posting of the changes. You are responsible for reviewing and becoming familiar with any changes. Your use of the Services following the changes constitutes your acceptance of the updated Terms.


12. Final provisions


The Althemy�s Privacy Policy, is an integral part of these Terms and conditions.
If any part of the Terms is found to be unenforceable, that part will be limited to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
